And so it passes out of human hands.
The non-Muslims particularly do not seem to understand the whole affair here. You can see this when they asked those questions after the mubahalah.
In effect, the matter is over. Shaiful has placed it in God’s hands. The court case, the political significance of the case, the advices from Anwar’s lawyers are all moot.
To my understanding, what Shaiful has done can be broken done into these;
1. He has claimed that on a certain date, Anwar had placed his member into Shaiful’s anus.
2. He has evoked the wrath of Allah if what he said was a lie.
3. He said he was willing to face any consequences Allah sees fit to befall upon him and his family should he be lying.
This act emulates what was done in the time of the Prophet (Peace be Upon Him) but that was a case of accusing a man and a woman of zina. I believe the actual act is irrelevant here: both acts are sexual and they are not allowed in Islam. The Mubahalah is the ultimate statement: the absolute last claim of truth and evokes retribution well beyond this life. Here, we are talking about being an accursed on earth and eternal damnation in hell. All sanctions that human courts and human laws can dish out have been rendered meaningless. His act compels a fellow Muslim to believe him: it is a matter of faith: he has evoked the authority of God. The only question left now is whether you are willing to set aside all else.
There are those who still question the validity of the oath, the circumstances of the act, the credibility of Shaiful, the motives behind the accusation, whether the act of consensual or not, and a multitude of other things that the human mind can think up. The situation remains the same: one man has said that another man had anal sex with him. That act is illegal in the eyes of the religion. He states that he is willing to suffer on earth and in the Hereafter if he lied. In this act, he is not asking for human justice, this has already been done in the courts. Whether he gets satisfaction in the courts is also irrelevant: he and the accused will stand in God’s court in the day of judgement.
Did he consent to the act? That too is not important, he claims that it happened. If he consented, then God will punish him for it: more precisely, God will punish them both for it. If he lied, God will punish him for it. For us the question is simple: do you want to believe?
For me, the answers are simpler now:
1. Do I believe it happened? Yes.
2. Do I believe that it Shaiful consented? I think we need to revisit the term “under duress” in this case or at least, wait until we hear the evidence.
3. Do I believe that the other party should be punished for the act? If it can be proven in the court of law, yes. If it cannot, that too is fine because God will take care of the matter.
4. Do I believe that we should vote the other party as our leader? This is a political question, it does not belong here.
Personally, It think the case is closed: we have to decide whether we want to believe Shaiful or not. Everything else, we leave to Allah: the ultimate judge.
The final question: how far is our faith in Allah.
